Anti-Spam and Communication Policy

Last Updated: Oct 8, 2024

This policy applies to all services provided by DS Softwares LLC that enable users to send communications through various channels, including but not limited to email, SMS, WhatsApp, Instagram, and other platforms ("Covered Services").

Agreement to the Policy

By using our Covered Services, you agree to comply with this Anti-Spam and Communication Policy. Covered Services may only be used to send messages to individuals who have explicitly consented to receive communications from you about the specific subject matter of the message. Any violation of this policy may result in suspension or termination of your account.

What Constitutes "Permission"?

Permission must be explicit, verifiable, and specific to the type of communication being sent. Examples include:

  1. Explicit Opt-In

    • The recipient has knowingly and actively agreed to receive communications (e.g., by checking an unchecked opt-in box).
    • Users providing their contact information during a sign-up, purchase, or registration process, with clear notification about the nature of communications they will receive.
  2. Transactional Context

    • The recipient has initiated contact or a transaction (e.g., inquiries, service requests, or support tickets).
  3. Event Participation

    • Contact details shared during events, contests, or surveys, provided recipients were informed about follow-up communications.
  4. Social Media Consent

    • For WhatsApp, Instagram, or similar platforms, the recipient has opted in to receive messages via those channels, such as responding to an invitation or explicitly initiating a conversation.

Rule of Thumb: Do not send communications to individuals or entities that have not explicitly agreed to receive them, regardless of the communication channel.

Compliance Guidelines

To ensure compliance, you must adhere to the following guidelines across all communication channels:

General Rules

  1. Proof of Consent

    • Maintain records of recipients’ consent for all communications.
    • Consent must be channel-specific (e.g., SMS consent cannot be assumed for WhatsApp).
  2. Prohibit Use of Third-Party Lists

    • Do not use purchased, borrowed, or scraped contact lists, regardless of their claimed quality.
  3. Accurate Sender Information

    • Ensure that sender names, profiles, and message headers are authentic and not misleading.
  4. Avoid Deceptive Content

    • Subject lines, message previews, and content must accurately represent the purpose of the communication.
  5. Unsubscribe and Opt-Out

    • Provide a clear, easy way for recipients to unsubscribe or opt-out for each communication channel.
    • For SMS, include "Reply STOP to unsubscribe" or equivalent instructions.
    • For WhatsApp and Instagram, ensure users can opt out through simple instructions.
  6. Content Labeling

    • Clearly label promotional messages as advertisements or solicitations, where applicable.
  7. Respect Communication Platform Policies

    • Adhere to the terms and conditions of third-party platforms (e.g., WhatsApp Business, Instagram, or SMS providers).

Channel-Specific Requirements

Email

  • Include a valid physical address in every email.
  • Ensure emails comply with local laws such as the CAN-SPAM Act, GDPR, or equivalent.

SMS

  • Limit SMS to recipients who have specifically opted in to receive messages via this channel.
  • Comply with TCPA or equivalent regulations in your region.

WhatsApp

  • Use the platform for permitted use cases only (e.g., transactional updates, customer support, or pre-approved templates).
  • Obtain explicit opt-in for WhatsApp communications.

Instagram or Social Media Platforms

  • Do not send unsolicited messages or use automation to spam users.
  • Respect user privacy and platform-specific guidelines for messaging.
